Abstract
Genetic testing can now identify workers who may be particularly susceptible to certain diseases, and employers are well aware that unhealthy employees can cost them substantial sums of money. To deny that employee illness imposes business costs invites accusations of irrationality or naivete', regardless of sensitivity to the feelings of others. This article discusses employer access to genetic testing information about workers and restraints which may or may not be imposed by the Americans with Disabilities Act 5 (ADA) on the acquisition and use of information revealing genetic abnormalities.
