Abstract
The Twentieth Anniversary Joint Conference of the Institute for Transnational Arbitration (ITA), through its Academic Council, and the American Society for International Law (ASIL) provided a prime opportunity for reflection and engagement about the future of international arbitration and how its values will evolve in the twenty-first century through this book.
The conference on 29 March 2023 bore the same title as this book, and the keynote speech and panels addressed wide-ranging, cutting-edge issues. Professor Hélène Ruiz Fabri, Director of the Max Planck Institute Luxembourg for International, European, and Regulatory Procedural Law, delivered a keynote speech titled ‘Taking Intersectionality Seriously’. Professor Ruiz Fabri explored the term ‘intersectionality’, coined by Professor Kimberlé Crenshaw of UCLA Law School and Columbia School of Law, to express the complexities of how multiple identities of individuals influence their experiences and senses of self, particularly those who have identities that have been historically disadvantaged or oppressed. She reminded us to take intersectionality seriously as we calibrate the sliding scale between repetition and reformation in international arbitration and that discrimination can be explicit or subversively hidden inside state regulation. She also reminded us that promoting the sovereignty of Indigenous people around the world includes recognizing them as agents of change and societal progress.
