Abstract
The past year has continued the trend, which began more than a decade ago, of increasing employee interest in and willingness to litigate about employee benefits issues. This trend may reflect increased employee attention to benefits costs, or a general rise in the level of anxiety about health and retirement benefits one would expect to see as baby boomers begin to retire in significant numbers. Regardless of the cause, the dramatic rise in benefits litigation shows no signs of abating. This has meant lots of work for ERISA specialists and a variety of interesting developments, appropriate for consideration at a meeting like this.
